1. Scope and contracting party
- These General Terms and Conditions apply to orders for goods placed via our online shop. The contracting party is Marcus Tetzner, trading as X-HUNTER, Satower Weg 9a, 24357 Fleckeby (hereinafter “we” or “us”).
- A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business or self-employed profession (Section 13 German Civil Code (BGB)). A trader is a natural or legal person or a partnership with legal capacity who, when entering into the legal transaction, acts in the exercise of their trade, business or self-employed profession (Section 14 BGB).
- Any deviating terms and conditions of the customer shall apply only if we expressly agree to their validity.
2. Ordering and conclusion of the contract
- The presentation of goods in the online shop does not constitute a binding offer to enter into a contract, but an invitation to place an order.
- You select items, place them in the shopping basket and can check and correct your entries before submitting. By clicking the button “Order with obligation to pay” („Zahlungspflichtig bestellen“) you submit a binding offer.
- A contract is concluded as soon as you receive our express order confirmation in text form, the ordered goods or our request for payment, whichever occurs first. A mere automatic acknowledgement of receipt of the order does not constitute acceptance. If a message also contains an express acceptance of the order or a request for payment, its content shall be decisive.
- The language of the contract is German. We store the order data. Consumers are entitled to a confirmation of the contract on a durable medium within a reasonable period after conclusion of the contract, at the latest upon delivery; this confirmation contains the contractual information required by law. If you have created a customer account, you can retrieve the order data there. The GTC can be accessed and saved on our website at any time.
- Additional statutory age and purchase requirements apply to the acquisition of certain items. A purchase contract replaces neither the required licence nor the proof of purchase authorisation. Goods are handed over exclusively after the authorisation has been successfully verified and all statutory requirements have been met.
3. Prices and shipping costs
- All final prices stated to consumers include statutory VAT. In addition, the shipping costs shown before the order is completed and, where applicable, any expressly displayed shipping surcharges and, for cash on delivery, the cash on delivery fee apply.
- We provide information on delivery areas, shipping methods, shipping costs and surcharges on the Shipping and Payment page and in the checkout before the order is placed. The total amount shown in the checkout is decisive.
- Price reductions or cash discounts apply only insofar as they are expressly stated in the specific offer or for the selected payment method.
4. Payment
- Depending on the shopping basket and approval, the following payment methods may be offered in the shop: bank transfer (payment in advance, also with 2 % discount), 25 % down payment, easyCredit instalment payment, easyCredit purchase on invoice, cash on delivery and, for approved customers, purchase on invoice. The availability of individual payment methods depends on the product and the shopping basket. The selection in the checkout is decisive; there is no entitlement to a particular payment method.
- Where payment in advance has been agreed, we will inform you of the amount payable and our bank details in the course of processing the order. The goods will be dispatched once payment has been received in full, provided that they are available and all statutory purchase requirements are met.
- When paying cash on delivery, you pay the total amount shown in the checkout, including the cash on delivery fee of €8.00, to the courier on handover of the goods. On handover, the courier (DHL) additionally charges a transfer fee of €2.00, which you pay directly to the courier. Cash on delivery is offered only to customers with a customer account from their second order or after individual approval; it is only available for deliveries within Germany, up to a goods value of €3,000, and not for weapons requiring purchase authorisation or ammunition.
- Purchase on invoice is offered exclusively to customers with a customer account whom we have approved for it beforehand on a case-by-case basis (in particular public authorities and public-sector buyers), and only with an invoice address in Germany. You receive the invoice by e-mail when the goods are shipped; it is also available in your customer account. The invoice amount is payable without deduction within 30 days of the invoice date by bank transfer to the account stated on the invoice. On request we also issue the invoice as an XRechnung; for this, please enter your Leitweg-ID and, if applicable, your purchase order number in the order comment.
- The use of easyCredit instalment payment and easyCredit purchase on invoice is additionally subject to the terms and notices of the respective payment service provider made available during the payment process. Provision is in particular subject to the review and approval of the selected payment method.
- For orders with an agreed down payment or for pre-orders, the specific amount of the down payment, the due date of the balance and the special delivery terms are displayed and agreed before the order is placed. The balance is payable only after separate notification in accordance with the agreement.
- If a customer is in default with a payment that has fallen due, the statutory provisions apply. Withdrawal from the contract due to non-payment is governed by the statutory requirements, in particular the setting of a deadline where required.
5. Delivery and availability
- We deliver to the countries stated on the Shipping and Payment page and in the checkout. Ammunition may be shipped within Germany using suitable specialised transport, provided that all statutory and transport-law requirements are met for the respective type of ammunition and the selected consignment. We do not ship weapons and ammunition subject to a licence requirement abroad as a regular service.
- Binding information on delivery times can be found on the respective product page and in the checkout. Considerably longer delivery times may apply to pre-orders and items not in stock; the delivery time displayed in the individual case is decisive. A mere label “available to order” („bestellbar“) does not replace specific delivery information.
- Where several goods with different delivery times are ordered, delivery is generally made together unless otherwise agreed. In this case, the longest stated delivery time is decisive.
- If delivery is delayed, we will inform you. The customer’s statutory rights in the event of delay in delivery, non-performance or impossibility remain fully unaffected. No general reservation of self-supply with automatic cancellation of our obligation to deliver is agreed.
- For items subject to a licence requirement, handover takes place only after the statutory requirements have been verified. The actual delivery date may be postponed due to outstanding required documents or official checks; statutory rights remain unaffected.
- Collection is possible by prior arrangement if we offer this option for the respective item.
6. Purchase requirements for regulated goods
- We hand over weapons subject to a licence requirement, essential weapon parts, sound suppressors, certain magazines restricted by law, ammunition and other regulated items exclusively to persons authorised to acquire them. We check the required proof and may request additional information where this is legally necessary.
- Age-restricted goods are supplied only to persons who have reached the minimum age required by law in each case. Depending on the item, an identity and age check is carried out on handover.
- Customers are obliged to provide accurate and complete information regarding their lawful authorisation to purchase. If there are doubts about the authorisation or if a handover in compliance with the law is not possible, the goods will not be handed over; further processing is governed by the statutory provisions.
- Further information is provided on the pages Proof of Age, Purchase Authorisation and Notice on Blank-Firing, Irritant and Signal Weapons (SRS).
7. Retention of title
The goods delivered remain our property until payment has been made in full.
8. Right of withdrawal
Consumers are generally entitled to a statutory right of withdrawal in distance contracts. For details, please refer to the separate Right of Withdrawal notice, including the model withdrawal form. The right of withdrawal is not excluded across the board for weapons, ammunition, pre-orders or reduced-price goods. Statutory exceptions apply only if their respective requirements are met in the individual case.
9. Liability for defects
The statutory rights in respect of defects apply. For goods with digital elements, the statutory obligations to provide updates also remain unaffected. Any additional manufacturer’s guarantee does not affect these rights. For consumers, the statutory provisions on consumer goods sales apply in particular.
10. Liability
- We are liable without limitation for intent and gross negligence and for damage resulting from injury to life, body or health based on a culpable breach of duty. Liability under the German Product Liability Act (Produkthaftungsgesetz) or on the basis of an expressly assumed guarantee remains unaffected.
- In the event of a slightly negligent breach of material contractual obligations, our liability is limited, to the extent permitted by law, to the damage typically foreseeable at the time the contract was concluded. Material contractual obligations are those whose fulfilment is essential for the proper performance of the contract in the first place and on whose fulfilment the customer may regularly rely.
- Otherwise, liability for slight negligence is excluded to the extent permitted by law.
11. Choice of law and dispute resolution
- German law applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). For consumers whose habitual residence is in another Member State of the European Union, the mandatory consumer protection provisions of that state remain unaffected.
- If the customer is a merchant (Kaufmann), a legal entity under public law or a special fund under public law, the place of jurisdiction agreed is – to the extent permitted by law – our registered place of business.
- We are not willing to participate in dispute resolution proceedings before a consumer arbitration board. Statutory information obligations in connection with an unresolved dispute remain unaffected. You may address complaints to kontakt@x-hunter.de or to our business address stated above.
